The Auctioneers’ terms and conditions are displayed at the Auction rooms and are in print on the Entry Form. Vendors and purchasers are therefore deemed to be aware of the terms of sale.
The Auctioneers reserve the right to catalogue and lot goods as they see fit. No commitment can be given as to when such goods will be offered for sale.
The Auctioneers give no guarantee as to the quality of the goods sold.
All persons attending a Sale under the conduct of the Auctioneers – whether at their Sale Rooms or elsewhere – shall be deemed to be on the land and premises at their own risk and shall have no claim against the Auctioneers or their principles in respect of the cancellation/postponement of a Sale or any loss, accident or injury, however occasioned, save in so far as the same is proven to be caused by the direct negligence of an employee(s) of the Company.
Persons handling lots do so at their own risk and shall make good all loss or damage howsoever sustained; such estimate of cost to be assessed by the Auctioneers whose decision shall be final.
At the fall of the hammer, the highest bidder, acceptable to the Auctioneers, shall be the Purchaser and any dispute shall be settled by the Auctioneers, whose decision shall be absolute and final. No lots shall be transferred.
The Auctioneers may divide, combine, add or withdraw lots and make any catalogue alterations without notice. They shall regulate the advance of bidding, accept or reject any bid at their discretion and without consultation and bid on behalf of the Vendor, where there is a reserve price or at their discretion.
The Auctioneers shall not be responsible for default on the part of Vendors or Purchasers. Any resultant deficiency, together with interest, cost and expenses, shall be made good by the defaulter, recoverable as and for liquidated damages. The Auctioneer, in appropriate circumstances, will enforce a Sale Contract at the fall of the hammer unless there are reasonable circumstances which would seem to indicate otherwise.
Any claim under any Statute must be received in writing within 10 days of the Sale.
PURCHASERS:
Catalogue descriptions shall be taken as a matter of opinion only. The Auctioneers accept no responsibility for faults or imperfections of any lot described in the catalogue or given verbally by a member of staff. Intending purchasers must satisfy themselves by inspection or otherwise as to the description, condition, quality and originality of any lot prior to bidding.
At the fall of the hammer, all lots shall be and remain, in every respect, at the absolute risk of the Purchaser, including those of fire, burglary, etc, and damage occasioned to lots by the removal of other goods.
The Auctioneers are prepared to accept commission bids on behalf of intending Purchasers unable to attend at the time of the Sale, providing requests are made in writing and up to half an hour before the commencement of a Sale and given to the Auctioneer or the Auction Rooms Manager. This complimentary service is made at the purchaser’s own risk and the Auctioneer cannot accept liability for failure to receive and/or place any such bids. The Auctioneers cannot be held responsible for, nor are they connected with, commission bids given to Auction Room Porters or any other member of the Auctioneers’ staff.
A Buyer’s premium of 17.5% plus VAT is chargeable on the hammer price.
If an asterisk (*) precedes any lot number, VAT will also be payable on the hammer price.
Payment for goods purchased at the Auction should be made on the day of the Sale or no later than the Saturday morning following.
No goods purchased at the Sale may be removed without payment first being made except with the express permission of the Auctioneers.
Purchasers are requested to collect all items bought by the Saturday morning following the Sale. Items not collected by 12:00 noon on the said Saturday will be subject to a storage charge of £3 per lot per day. Should the items still remain after 14 days, the Auctioneers reserve the right to re-offer them in the next available Sale to recover costs.
VENDORS:
It is a condition of the Auction that the Vendor indemnify the Auctioneers against all and any claims made in connection with the goods sold.
STANDARD SALE CHARGES
A lotting fee of £6.50 per lot will be levied on every lot entered for auction on each occasion it is offered for sale, this charge covers the catalogue description, research and marketing. The lotting fee is payable irrespective of whether the lot is sold or not sold.
A commission charge of 13% of the Hammer price will be deducted from the proceeds of the sale.
A loss and damage waiver of 1.5% will be charged on the total sale price.
VAT at the prevailing rate will be levied on all fees.
1. REMOVAL COST
The vendor is responsible for the delivery of items to the auction rooms. We are happy to assist you with transport, whether it is a single item or complete house clearance, which will be at your expense.
2. LOSS AND DAMAGE OF GOODS
Bourne End Auction Rooms assumes liability for property consigned to us, at the lower pre-sale estimate until title passes to the buyer or to the reserve if the lot was unsold. For this we charge 1.5% plus VAT.
3. RESERVES, GUIDE PRICES AND AUCTIONEERS DISCRETION
Reserves should be mutually agreed between the vendor and the auctioneers but all lots valued with a lower estimate of £30 or less must be offered without reserve. AD - Auctioneers Discretion may be used to sell a lot up to 15% below the reserve unless a fixed reserve is specified at the time of entry.
4. ELECTRICAL ITEMS
These are subject to detailed statutory safety controls. Where such items are accepted for sale you accept responsibility for the cost of testing by external contractors. Goods not certified as safe by an electrician (unless antiques) will not be accepted for sale. They must be removed at your expense on you being notified. We reserve the right to dispose of unsafe goods which will be taken as refuse, at your expense. The removal of wiring/plugs may be necessary on certain items.
5. SOFT FURNISHINGS
The sale of soft furnishings is strictly regulated by statute law in the interests of fire safety. Goods found to infringe safety regulations will not be offered and must be removed at your expense. We reserve the right to dispose of unsafe goods as refuse, at your expense.
6. DESCRIPTIONS
Please assist us with accurate information as to the provenance etc. of goods where possible. Where we are obliged to refund a buyer when an item is a deliberate forgery and we have accounted to you, you agree to reimburse us for the sale proceeds.
7. WITHDRAWN ITEMS
If an item is withdrawn after it has been catalogued, the lot will incur charges at our discretion. These would normally include the vendors commission, loss and damage warranty, lotting fee and buyers premium. These charges will be calculated on the mid auction estimate.
8. UNSOLD ITEMS
We will notify you by email/phone after the auction of any unsold items. These will be re-offered in the next appropriate auction. Unless you instruct us otherwise, the estimate and reserve will be reduced by 25%. Where in our opinion an item is unsaleable you must collect the item/s from the saleroom by Saturday morning following the auction, unless agreed otherwise. After this time we reserve the right to charge for storage. In these circumstances at a daily rate of £5 per lot will apply. If you do not remove the lot within 3 weeks we reserve the right to sell it and defray charges from any net proceeds of sale or to consign it to the tip.
9. CONDITIONS OF SALE
You agree that all goods will be sold on our Conditions of Sale. In particular you undertake that you have the right to sell the goods either as owner or agent for the owner. You undertake to compensate us and any buyer or third party for all losses liabilities and expenses incurred in respect of and as a result of any breach of this undertaking.
10. AUTHORITY TO DEDUCT COMMISSION AND EXPENSES AND RETAIN PREMIUM AND INTEREST.
You authorise us to deduct all charges from the sale proceeds. We have the right to sell an unsold item by private treaty, in which case all the charges mentioned will apply as if it had sold at auction.
11. SETTLEMENT
We will normally pay out for items sold within three weeks of the auction by cheque or bank transfer if correct details have been provided, unless the buyer has not paid for the goods.
